Fear of election gains sparks a bid to alter the law

Trade unions want the right under UK law to expel British National Party activists - and deny them membership - as part of Labour plans to check the electoral advance of the far right.
Labour backbenchers, supported by all the biggest unions, will unveil the plan on Tuesday when they put forward an amendment to the Employment Bill that would allow them to ban racists. The proposal - labelled 'Stalinist' by the BNP - comes amid concern that it could win as many as three seats in next year's European Parliament elections and make strong gains in council elections.
Labour MPs, many of whom feel threatened by the BNP's advances in their constituencies, are concerned that the party is encouraging activists to infiltrate unions in order to spread subversive, racist messages in the workplace.
Tony Lloyd, chairman of the trades union group of Labour MPs who has tabled the amendment, said it was vital that unions had the right to get rid of people working directly against their aims: 'What the unions are absolutely right to demand is the right to kick racists out of their organisations.'
Until now unions have had to work under a legal framework set down under the Thatcher government in the early 1990s which prevented them from excluding people because of their membership of a particular political party. The Tory rules were seen at the time as a ploy to prevent unions from excluding or expelling those who broke strikes or were Conservative party members.
But the government has to bring UK law into line with European law after Aslef, the train drivers' union, won a landmark case in the European Court of Human Rights which upheld its right to expel a driver who was a BNP activist.
A spokesman for Thompsons solicitors, the trades union law firm, said: 'The amendment would mean a union could expel or deny membership to someone whose membership of a political party runs contrary to the union's rule book.'
The BNP has 10,000 members across Britain and 46 councillors. Labour is worried that under the proportional representation system that will be used in European parliamentary elections next June it could secure seats in three of the 12 regions.
Experts say that, under the list system, the BNP would need as little as 7.5 per cent of the vote in northwest England and only 11 per cent in Yorkshire and the West Midlands to install Euro-MPs in the Brussels and Strasbourg parliament. Labour also fears the BNP could become the largest party in two councils - Barking and Dagenham in Essex and Stoke-on-Trent - in next year's council elections if its anti-foreigner rhetoric struck a chord during the recession.

Burn hell of girl 'raped by ten men'

A GANG raped a girl of 16 — who had a mental age of eight — then poured caustic soda over her, a jury heard yesterday.
Up to ten men, some with hoods over their faces, attacked her and filmed it on mobiles.
The gang — including Miguel Almeida, 22, and Opeyemi Ismail, 20 — allegedly fled laughing as the chemical left her screaming in agony.

The girl was in hospital for months with 55 per cent of her body burnt. Police had to wait more than two months before they could get her account of what happened.
The jury yesterday listened to a harrowing 999 call of the girl’s screams as a neighbour called an ambulance.
The victim was picked on because she previously had consensual sex with some of the gang, it was claimed.
Prosecutor Rosina Cottage told the jury: “They thought she was, to use the words of a number of these defendants, a ho — a whore — a dirty ho who was asking for it.”
Rogel McMorris, 18, allegedly lured the girl to a derelict house in Tottenham, North London, in January, where the ten were waiting.

McMorris, of Stockwell; Almeida, of Edmonton; Ismail, of Leyton, and four others all deny rape. Five also deny serious assault. The trial continues at Wood Green Crown Court.

A shy girl of 16 with learning difficulties was raped by up to ten men who then burned her with caustic soda, a court heard yesterday.
The teenager, who has a mental age of about eight, had skin peeling off her face, chest and genital area because her tormentors poured water on her, intensifying the burning, jurors heard.
As the unnamed girl screamed, the gang laughed and ran away, said prosec­utor Rosina Cottage.
One defendant, Bradley Daley-Smith, apparently later told a friend: 'She was a ho and she deserved it.'
Seven men are accused of the rape at a derelict house in Tottenham, north London, in January.

The alleged victim planned to meet a friend, who is not on trial, but was instead met by Rogel McMorris, 18, who allegedly took her to the abandoned property.
Two hours later, neighbour Helen Riddell heard 'frantic screams'.
She found the alleged victim covered in a white powder with pink patches on her peeling black skin.
In Ms Riddell's 999 call, played to the jury, the girl's cries could clearly be heard. She told police she had had sex with 'about ten males' without her consent.
'Naked, screaming and crying, she was in no position to make up a cover story,' said Ms Cottage.
She was left with burns on half her body and 'severely disfigured', despite months of operations.
She could not speak for a month after the alleged attack.
She was probably picked on because she had previously agreed to sex with Mr Hendricks and Daley-Smith in a bid to be popular, added Ms Cottage.
McMorris, of Stockwell, South London; Daley-Smith, 22, and Miguel Almeida, 22, both of Edmonton, North London; Jason Brew, 19, and Bruno Abrantes, 24, both of Tottenham; Hector Muaimba, 20, of Walthamstow, East London; and Opey­emi Ismail, 20, of Leyton, East London all deny two counts of rape. Five also deny GBH with intent. The trial at Wood Green Crown Court continues.

Chief Constable responds to calls for positive discrimination

THE Chief Constable of North Yorkshire has spoken out following calls for positive discrimination to boost the number of black and Asian police officers.
As reported in The Press, Commander Ali Dizaei, of the Metropolitan Police Force, speaking at the Black Police Association’s national conference in York, called for positive discrimination in favour of ethnic minorities. He said such a move would help to combat terrorism.
But Chief Constable Grahame Maxwell, the head of the North Yorkshire force, said that although there were plus points to positive discrimination, it could also be divisive.
He said positive discrimination had been talked about in the UK for a long time and had been tried by police forces in America with both positive and negative consequences.
Mr Maxwell said: “You’re not seen as an equal opportunities organisation and it does create disharmony among colleagues.

Police commander Ali Dizaei suspended for the second time

Ali Dizaei, the controversial Scotland Yard commander who is president of the National Black Police Association, was suspended from duty last night.
The Metropolitan Police Authority-said that its professional standards subcommittee had considered allegations concerning Commander Dizaei and decided to take action.
The suspension is likely to exacerbate racial tensions within the Metropolitan Police. Mr Dizaei has also been a key supporter of Assistant Commissioner Tarique Ghaffur, the country’s most senior ethnic-minority officer, who was relieved of his duties this month. Mr Dizaei was privy to closely guarded details of Mr Ghaffur’s dossier of evidence of alleged racism and discrimination. He also spoke to the press on behalf of Mr Ghaffur as the dispute became increasingly acrimonious.

Controversy
From 2000, Dizaei was investigated by the force after allegations of taking bribes, using drugs and prostitutes, and even spying for Iran. There were counter-allegations by his supporters that the investigation was prompted by the belief of some senior officers that he was too ambitious, too critical of the police (particularly relating to racism), too close to the Iranian community, and too flamboyant. He flouted uniform rules by wearing designer belts, sunglasses and cowboy boots, visited expensive nightclubs, and had an "open marriage", none of which endeared him to more conservative officers.[2] The investigations, codenamed Operation Helios, officially cost £3 million.
Dizaei was suspended on 18 January 2001. Eventually, he was charged only with perverting the course of justice, misconduct in public office, and making false mileage expense claims. His supporters claimed that these relatively minor charges were made because no evidence could be found of any other wrongdoing and the Metropolitan Police wished to justify its very expensive investigation.
Dizaei was actually tried before the Recorder of London for misconduct in public office and perverting the course of justice. This arose out of an incident which occurred on 6 September 2000. His BMW, provided by the Metropolitan Police, was vandalised while parked at Emperor's Gate in Kensington, but Dizaei reported that the vandalism happened 0.8 miles away in Cope Place, near the police station. Unfortunately for him, he was already under surveillance by undercover officers, who knew where the car was parked. When this was put to him in the trial, Dizaei admitted that he had lied, but said that the damage had indeed occurred in Cope Place. He claimed he had noticed it when he returned to his car, but had then driven to Emperor's Gate (which was near an Underground station) to catch a train to a National Black Police Association (NBPA) meeting. He lied, he said, because he did not want his superiors to know he had attended the meeting. The jury cleared Dizaei of the charges on 15 September 2003. The Crown Prosecution Service decided not to proceed with the charges of making false mileage expense claims.
The NBPA, of which Dizaei is a leading member (he was vice-chairman and is now the president and legal adviser), called for a full independent investigation into the Metropolitan Police investigation, which has been referred to as a "witch hunt" and proof that racism still exists in the British police.
Dizaei brought his own claim for race discrimination in the conduct of the investigations by the Metropolitan Police which was withdrawn in 2003 after the Metropolitan Police paid Dizaei a reported £80,000 and reinstated him.
In 2004, the Independent Police Complaints Commission called the investigation "seriously flawed".[3] Dizaei eventually only faced minor disciplinary action, having been cleared of all criminal charges or any other misdemeanour.
Dizaei was promoted to Chief Superintendent in May 2004[4] and became Borough Commander of Hounslow. He is now Borough Commander of Hammersmith and Fulham. In 2006 he was in the headlines again for criticising the Forest Gate raid[5] and passenger profiling on aircraft. The Police Federation has accused him of "blissful ignorance" for the latter.[6]
In December 2006, it was made public that during Operation Helios the Metropolitan Police had unlawfully tapped over 3,500 private calls made by Dizaei.[7] The ruling was made by the Investigatory Powers Tribunal after referral by the Black Police Association.
In March 2007, Dizaei published Not One of Us, an account of his police career to date, and of the Operation Helios investigation. Prior to publication, the Metropolitan Police Service issued a statement noting that it "considers it a matter of regret that Chief Superintendent Dizaei has felt it necessary to write this book", and reiterating its support for the Helios team. [8]. Upon release the book was serialised on BBC Radio 4.
In June 2007, Sir Ian Blair apologised for Operation Helios, after the Metropolitan Police and the Black Police Association agreed to resolve disputes arising out of Helios.[9]
In March 2008, Ali Dizaei was promoted to the rank of Commander after three previous promotion attempts.
However, it was announced on 12 September 2008 that Dizaei was again the subject of a complaint, this time alleging that he had improperly provided advice to solicitors defending a woman accused over a fatal hit-and-run accident. The Metropolitan Police Association is to investigate the alleged misconduct, which Dizaei denies.[10]
He was suspended again on 18 September 2008 after being investigated for various corruption charges including an arrest he made outside his uncle's West London restaurant. The arrested man later made a complaint that is being investigated by the Independent Police Complaints Commission (IPCC). He was also alleged to have used his Metropolitan Police credit card for personal shopping while on a trip to the United States.

Suspected 'Holocaust denier' Dr Gerald Toben today won his fight against extradition to Germany where he is wanted for publishing anti-Semitic material on his website.
Dr Toben, 64, a prominent Australian academic, is wanted to stand trial for posting the alleged diatribes between 2000 and 2004.
The German authorities claim they are 'of an anti-Semitic and/or revisionist nature'.
In the European Arrest Warrant issued in October 2004, he is accused of approving of or playing down the murder of the Jews by the Nazis.
But District Judge Daphne Wickham ruled the warrant invalid as it contains inadequate detail about the offences.
It neither states the name of the website nor where the propaganda is said to have been published from - merely referring to the 'world-wide internet'.
After discharging Toben, Judge Wickham granted him bail pending an appeal by the German authorities.
But he was not expected to be released today, after she imposed a series of strict conditions including a £100,000 security.
Grey wavy-haired Toben, smartly dressed in a suit, appeared pleased on hearing the judge's decision from the glass-fronted dock at City of Westminster Magistrates' Court.
The public gallery was packed with his supporters.

Judge Wickham rejected an argument from Melanie Cumberland, for the German authorities, that the required information could be acquired.
The judge said: 'Compliance, in my view, cannot be fulfilled by a drip-feed of information as and when the issuing authority provides it.
'I find that the particulars are vague and imprecise, I find the warrant invalid and therefore discharge the defendant.'

She added that she had not been required to decide at this stage whether the alleged crimes were valid extradition offences.
Toben has been in custody since October 1, when he was arrested at Heathrow Airport on a flight from America, on his way to Dubai.
He was refused bail at that time because it was feared he could easily evade the authorities.
Ms Cumberland opposed bail today but Ben Watson, defending, successfully argued it would be 'abhorrent' to keep him behind bars any longer.
His other bail conditions include residence at an approved address, written confirmation from the Australian High Commission of which passports he holds, and not to access the internet.
He is also banned from giving press interviews. These were safeguards 'to prevent any public order act offences', said Judge Wickham.
Toben claims he will not get a fair trial in Germany.
The controversial author was reportedly jailed in 1999 at Mannheim prison for breaching Germany's Holocaust Law Section 130, prohibiting anyone from 'defaming the dead'.
Toben's Adelaide Institute website has drawn criticism for many years.
In 2000 he fought an order by the Human Rights and Equal Opportunities Commission in Australia to remove its 'offensive' content.
The commission claimed it breached Australia's Racial Discrimination Act.
Toben completed his Dr of Philosophy course at the University of Stuttgart in 1977 and taught in schools and colleges all over the world.
He founded the Adelaide Institute and is the author of 10 books on education, political science and history.
When his Heathrow plane was cleared of passengers flamboyant Toben moved seats which officers suspected was a bid to evade detection.
When cautioned he replied: 'You can't arrest me on British soil.' At an earlier hearing he accused the 'world press' of wrongly portraying him as 'horrible, terrible, vicious' and said: 'I must respond to that, because this is nonsense.'

Attempting to reassure the court he would not jump bail, he added: 'The world is my prison.
'I'm well known and to suggest there's no honour in my person is to slander me.'

Toben went on to claim he could not be tried in Germany due to 'double jeopardy', referring to ongoing proceedings on the same issue in Adelaide.
He also suggested the new warrant was a re-hash of the old matters he was convicted of in 1999 but with a 'cyber-crime' veneer.
Toben appeared to admit he left Germany without serving his prison sentence after paying 6,000 Deutschmarks for bail.
He said: 'I can't defend myself in Germany because if I open my mouth the prosecutor says I'm in contempt.'

Two extreme right-wing groups, the Dělnická strana (DS) and the Národní strana (NS), want to exploit today's 90th anniversary of the creation of an independent Czechoslovakia by holding demonstrations in Prague. DS supporters will gather in the afternoon on Jiřího z Poděbrad square, while NS supporters will gather in the early evening on Wenceslas Square. Police have evaluated the DS event as high-risk, as the party is connected with ultra-right wing and neo-Nazi groups such as Národní odpor ("National Resistance" - NO).
On its web pages, DS announces it will celebrate the state holiday on 28 October by holding a gathering entitled the "Day of National Unity", which is to be aimed "against the system and for the nation". Representatives of various organizations are to give speeches at the event. DS also wants to officially launch its campaign for next year's EP elections at the gathering. Several civic associations have recently called for the DS to be dissolved.
The nationalist NS has called on people to come support "the only pro-national political party in the Czech Republic" at its celebration of the creation of the Czechoslovak Republic. The NS meeting is scheduled to be preceded by the screening of the controversial anti-Muslim film Fitna ("Disagreement") by the extreme right-wing Dutch MP Geert Wilders. NS chair Petra Edelmannová and British National Party chair Nick Griffin will then speak.
