Heretical Two Once Again Arrested

Comment: Received early this morning in an email from a third person.

"Dear All,

Unfortunately Simon Sheppard was re-arrested this afternoon for being in breach of his licence (which ends in April). The same thing happened with Steven Whittle a few months before his licence ended. There are no further details yet regarding the reason for the arrest, or the prison they are sending Simon to. I was phoned by the custody sergeant at York police station at about 9 pm this evening so have passed the information on to his barrister xxxxx.

I can’t help thinking that the timing is odd – very near to Holocaust Memorial day, but perhaps that is one more coincidence...

Released: Simon Sheppard



A man jailed for inciting racial hatred online in a landmark case is being released after serving less than half his sentence.

Simon Sheppard, 53, was arrested in 2008 after police traced a leaflet called "Tales of the Holohoax," which had been pushed through the door of Blackpool Reform Synagogue, to a post office box in Hull, registered to Sheppard.

He was charged with Stephen Whittle, 44, from Preston, with publishing, possessing and potentially distributing racially inflammatory material.

Sheppard, from north Yorkshire, ran Heretical Press, a website which featured racist material, some of it written by Whittle.

Sheppard was found guilty on 16 counts in January 2009 after he was tried in absentia when he and Whittle fled to Los Angeles mid-way through the trial. In June that year they were deported back to Britain.

Sheppard was sentenced to four years and 10 months and Whittle to two years and four months in July 2009, but in January 2010 the sentences were reduced, Sheppard's by one year and Whittle's by six months.

According to the far-right British People's Party website, Sheppard will be released next week but will be banned from accessing the internet.

The BPP website also claims that Whittle was initially released last year but was allegedly caught on the internet in breach of his bail conditions and sent back to prison.

HERETICAL TWO IN COURT AGAIN


A forfeiture hearing took place on Friday July 31st before judge Grant at Leeds. The judge decided every contested point against Simon, and ordered the forfeiture and destruction of large amounts of valuable office equipment - mainly comprising large printers, which Simon had serviced - Simon's computers were old though. The forfeiture act was intended to deal with goods obtained by drug dealers, so this is clearly a gross abuse of power. The Prosecutor proved more willing to make concessions in Simon's favour than the judge!

An appeal was lodged to-day against sentence, and will be lodged within the statutory twenty-one days against forfeiture of the more innocuous items of office equipment.

A half-caste prisoner attacked Simon and Steve on their way to Court. Simon may have a fractured tooth. This seems curious, as they were guarded and prisoners in transit would normally have other things to think about - so it sounds like a set up.

One bit of good news is that Steve is to be moved to a lower category of prison very soon. Simon is likely to follow. Steve has been given an early release date in April, which is also good news in view of the length of his sentence. He may apply for bail pending appeal shortly, as he was only convicted of internet counts. Simon cannot do so, as he was convicted for hard copy publication as well, and refused leave to appeal in respect of those matters.

Simon intends to go to the European Court of Human Rights to challenge the Court of Appeal's refusal to review its notorious decision in Reg. v. Birdwood. It upheld judge Pownall's decision that "the truth is no defence" in race cases.

The Carshalton PO box has been shut down - presumably as act of spite by the Post Office's internal branch (security), as money has been sent to the Heretical Two via the PO Box. I have asked customer support to reopen it and will demand compensation.

The Heretical Two would much appreciate letters of support, as there has been none from the BNP, which in fact has been hostile. At least Gary McKinnon, the hacker has had the support of large numbers of Lefties.

Heretical two jailed for 'race-hate' crimes




A Selby man who fled to the United States after waging a campaign of hate against Jews and other minority groups has been jailed.


Simon Sheppard, 52, was convicted, along with Stephen Whittle, 42, of a number of race hate crimes. He was sentenced to four years and 10 months, while Whittle was jailed for two years and four months at Leeds Crown Court.

The pair had two lengthly trials. During the first, in July last year, the pair skipped bail and fled to California, where they sought asylum claiming they were being persecuted for their right-wing views.
They were deported back to the UK last month.

The investigation into the men began when a complaint about a leaflet called "Tales of the Holohoax" was reported to the police in 2004 after it was pushed through the door of a Synagogue in Blackpool.

It was traced back to a post office box in Hull registered to Sheppard.
Police later found a website featuring racially inflammatory material. Other published material included grotesque images of murdered Jews alongside cartoons and articles ridiculing ethnic groups.

The pair were charged with publishing racially inflammatory material, distributing racially inflammatory material and possessing racially inflammatory material with a view to distribution.

Sheppard, of Brook Street, was found guilty of 16 offences and Whittle, of Avenham Lane, Preston, Lancashire, was found guilty of five.

Judge Rodney Grant said: "I can say without any hesitation that I have rarely seen, or had to read or consider, material which is so abusive and insulting ... towards racial groups within our own society."

TWO men who skipped bail and fled to the US 11 months ago after a jury convicted them of peddling race-hate on the internet were yesterday back in the dock at Leeds Crown Court.
BNP reject Simon Sheppard and Stephen Whittle were convicted in Leeds last July of publishing racially inflammatory written material online.

A judge granted them bail before they were due to be sentenced.

But the far right pair skipped the country and jetted to Los Angeles in California where they claimed political asylum.

However, a US immigration judge turned down their asylum claim and Shepherd, 52, of Brook Street, Selby and York University graduate Whittle, 42, of Avenham Lane, Preston, waited for deportation back to the UK.

Both men admitted failing to answer bail when they apeared in court at a brief hearing in Leeds yesterday.

Judge Rodney Grant remanded both men in custody until sentencing on July 10.

Judge Grant said: "They must understand is at the forefront of my mind."

Mr. Davies, for Whittle said he has "substantial mitigation" because he came back to the UK voluntarily after the US authorities gave him the option of travelling to New Zealand instead.

Pony tailed Whittle, who nonchalantly read a book in the dock, contributed to Sheppard's website, which featured offensive material.

Thousands of far-right supporters logged on to the site to view more than 100 articles by Whittle, as well as items posted by Sheppard.

The investigation into Sheppard started in 2004 when copies of a pamphlet, Tales of the Holohoax, were pushed through the letterbox of a Blackpool synagogue and sent to a prominent Jewish academic.

Sheppard , was expelled from the British National Party in 1999, was also caught delivering racist pamphlets in NorthYorkshire.

Last July, the jury at Leeds convicted Sheppard of 16 charges relating to the possession, publication and distribution of racially inflammatory material.

Whittle, was convicted of five counts of publishing racially inflammatory material.

A Preston man, seeking asylum in the United States after being convicted of hate speech crimes in the UK will be deported after nearly a year in US custody.
Stephen Whittle, 42, and Simon Sheppard, 52, of Selby, fled in July 2008 after being convicted of publishing hate speech against Jews and other groups on their website.

The men sought asylum under America's free speech protections, claiming they were being persecuted for their right-wing views.
They were taken into custody at Los Angeles International Airport when they asked a uniformed US official for help.

An immigration judge ordered that the men be deported to the UK to face justice, the Los Angeles Times reported.
Sheppard and Whittle fled the UK last July during a trial at Leeds Crown Court after being released on bail while the jury deliberated over further charges after convicting them on several counts.

Heretical Two Denied Political Asylum In U.S.

Dear Harold,

You were right. Our asylum claim has been denied, as has witholding of removal.

We were thinking of appealing and sticking it out, but really this place is replete with people hanging on hoping for a miracle that's never going to happen, and we don't want to join them.

Our barrister told us when he visited to testify for us that this immigration judge, Rose Peters, has granted asylum to an IRA murderer who had killed two policemen, supposedly on political grounds, so that's the level of hypocrisy we're up against.

Better we think to go back to England, face the music, and get it over with.

The ground for refusing asylum was that our prosecution in the UK did not constitute persecution (i.e. the government attorney and the IJ, both women, agree with it.

The government attorney even argued against the First Amendment.) I believe that because this is a subjective assessment it is quite difficult to appeal against, and we could spend years taking it through various courts.

Men convicted of race hate crimes

Two men have been convicted of publishing "obnoxious and abhorrent" racist material.
Simon Sheppard, 51, of Brook Street, Selby, and Stephen Whittle, 41, of Avenham Lane, Preston, have been found guilty of a number of offences.
A trial at Leeds Crown Court heard they printed leaflets and controlled websites featuring racist material.
The pair, who are currently in the hands of US immigration authorities, will be sentenced in March.

Sheppard and Whittle were originally convicted of race-hate offences at a trial in July last year.
At an earlier hearing, Sheppard was found guilty of 11 offences and Whittle was found guilty of five offences.
The jury was unable to agree a verdict on a further seven charges against Sheppard and it was decided he would face a retrial on six of these charges.
The retrial began on 8 December and concluded on Thursday.
It was held in the absence of Sheppard as he and Whittle fled to America before the jury returned verdicts in the first trial.
The court heard the investigation into Sheppard began when a complaint about a leaflet called "Tales of the Holohoax" was reported to the police in 2004 after it was pushed through the door of a Synagogue in Blackpool.
It was traced back to a post office box in Hull registered to Sheppard.

Reviewing lawyer Mari Reid, of the CPS's Counter Terrorism Division, said: "People are entitled to hold racist and extreme opinions which others may find unpleasant and obnoxious.
"What they are not entitled to do is to publish or distribute those opinions to the public in a threatening, abusive or insulting manner either intending to stir up racial hatred or in circumstances where it is likely racial hatred will be stirred up.
"The vast majority of the material in this case concerned Jewish people, but there was also material relating to black, Asian and non-white people generally, all described in derogatory terms using offensive language.
"As well as printed leaflets, there was evidence of Simon Sheppard controlling websites which featured racist material, some of it written by Whittle, under the pen name of Luke O'Farrell."
The pair were charged with publishing racially inflammatory material, distributing racially inflammatory material and possessing racially inflammatory material with a view to distribution.
Mrs Reid said: "Both juries saw some thoroughly unpleasant material which contained views which most people would find obnoxious and abhorrent."

NO REMEDY FOR JAILED BRITISH "HERETICS"

Two jailed writers who were convicted in Britain of Internet hate speech on a U.S.-based website will be forced to remain in special asylum proceedings with no right to a bail hearing, a Los Angeles Immigration Court judge ruled October 14, 2008.


"That is a very bad blow to their hopes of freedom in the near future, and indeed to all asylum seekers and defenders of free speech in the United States," said Paul Ballard from the United Kingdom, coordinator of a legal defense fund for the pair known as the "Heretical Two" (based on the website www.heretical. com).


The pair, Simon Sheppard and Stephen Whittle, have since July14 been in the custody of the U.S. Department of Homeland Security in a Santa Ana, California contract detention facility, after disembarking that same date from a plane at Los Angeles International Airport, where they immediately asked for political asylum.
They fled Britain after being convicted July 11 in a Leeds courtroom of inciting racial hatred for publishing writings such as "Don't Be Sheeple" and "The Holohoax," including some published on Sheppard's website operated from a server in Torrance, California. Ballard noted that British law since 1986 allows for criminal conviction for speech if the subject speech is "likely to result"in the "stirring up" of racial hatred.
A conviction requires no proof of violence or intent. During the trial competing expert witnesses were called to testify as to whether Jews, an offended group, were a "religious" or "racial" group, since British law does not criminalize stirring up religious hatred.

The Heretical Two, who consider themselves political satirists and nonviolent gadflies, are the first persons to be prosecuted in Britain for Internet speech made on a Web server in another country, says Ballard.


They were charged under Britain's Public Order Act of 1986 and are subjected to penalties enhanced by the British Prevention of Terrorism Act of 2000. Since that time, Britain has arrested another man, Frederick Toben, an Australian, for speech denying "the Holocaust," based on a German arrest warrant issued for Toben.
Toben was taken into custody October during a layover at Heathrow Airport. "These two alarming cases are related in that both of them are attempts by the British Crown to criminalize speech regardless of where it takes place and whether it is legal in the place where it was made," noted Bruce Leichty, a San Diego County attorney who was retained in September to represent the Heretical Two.
The October 14 Los Angeles Immigration Court decision in the Sheppard and Whittle cases leaves the two in need of the remedy of habeas corpus (literally: we have the body), a process which federal legislators in the U.S. have made more difficult and costly for immigrants in recent years, according to Leichty.


Leichty said the actions of the U.S. government to date have added insult to injury. "Here are two British individuals who published speech that was legally protected in the United States,for which they were criminally prosecuted in Britain," said Leichty, " and now the case has taken an even more Kafkaesque turn since the one country that should be protecting them from imprisonment in Britain has instead thrown them into U.S. jail for

an indefinite period of time, based only on the fact that they requested political asylum. "Refugees are protected by international treaty; no country should treat political refugees like these two have been treated,particularly where they enter the host country legally." Leichty notes that Homeland Security admitted in its Immigration Court brief that the two were admitted to the United States under the U.S. Visa Waiver Program, and that until they made their request for political asylum at Los Angeles Airport DHS had no reason to suspect or detain them.
Once the two told their story to airport officers, however, DHS attempted to revoke its decision admitting them to the U.S. and to declare the two "inadmissible" on the ground that they entered with the intent to stay in the U.S. as immigrants, which Leichty says is both preposterous on the facts of the case and in any event not within the powers of airport officers." It is well established that an asylum claimant does not give up his non immigrant status simply by telling his host country that he needs the protection of political asylum."


The special type of proceeding that the two were put into,called an "asylum-only proceeding" where immigration judges do not have the authority to release the alien from detention, is used in connection with the Visa Waiver program only for asylum applicants who are not already admitted into the country, or those who have overstayed their authorized periods of stay--neither of which applied to Sheppard and Whittle when they sought asylum. to these points and ruled that DHS officers had "discretion" to issue the notices that put the two into the special proceedings. Leichty said that, although the recent and more notorious arrest of Frederick Toben in London involves a German extradition request, he is not aware of any request by the U.K. for the extradition of Sheppard and Whittle, and in any case the United States typically does not extradite persons who are convicted of crimes which are not crimes in the U.S."


It is clear that obsessive security apparatuses in two different countries have now run amok, by respectively making criminals out of dissidents and by locking them up even though they are not criminals.


One does not have to share the views or style of the Heretical Two to appreciate the threat posed by this type of case to individual rights and liberties.""The laws under which Sheppard and Whittle were prosecuted could just as easily be used to subject nonconformist American publishers to criminal penalties in Britain."


Sheppard has described his website as a mixture of"blasphemies, heresies, and scientific and general interest material" established to promote his ideas on subjects such as politics, race and gender relations. He holds an Honors bachelor's of science degree in mathematics from the University of Sussex and published two medical scientific papers prior to becoming a publisher and web developer. Whittle is a First Class Honors B.A.graduate in languages and linguistic science from the University of York, and has written numerous books. Sheppard says he and Whittle were prosecuted based on the

charge that their writings could be viewed by persons in England and Wales, and not even on any evidence that the writings had actually been viewed by anyone other than a police officer who downloaded material for the purpose of bringing charges. "Both men state that they were living peaceably and civilly in Britain until the police disrupted their lives by raiding their flats and seizing their papers and property," says Leichty.


The British press has repeatedly referred to them as the "race hate pair." "There are people who want to criminalize `hate speech' in the U.S., too," noted Leichty. "But as officers of the court,attorneys should remind people that even speech perceived as hateful deserves protection. One man's `hate' may be another man's passion or critique, or even another man's creed. The United States should lead the way in showing disapproval of those nations who have sought to restrict the nonviolent expression of opinion and belief. "The Heretical Two are no more criminal than many of our American forebears who fled repression to settle this country--and no doubt they may say repugnant things just like other blogging Americans.


Ignore or despise them or ridicule them if you wish,dialogue with them if you dare, but don't imprison them."

In choosing Los Angeles as their destination, the pair had hoped to visit with other dissidents at the Institute for Historical Review, Costa Mesa, one of whom had been designated by the defendants as an expert witness in their British case on the historicity of various standard Holocaust accounts, said Leichty.

Ballard says the U.S. imprisonment of the two, and the legal costs associated with their defense, caught British nationalist activists by surprise.


Asylum claimants are on their own in the U.S. unless they can afford attorneys. "This is such an important case with such far-reaching implications that my colleagues and I could not simply let Simon and Stephen languish in detention without counsel," Ballard said.


Ballard is spearheading the Legal Defence Fund that has been set up in the U.K., which he says is accepting contributions in all currencies addressed as follows:

"The need for American participation in legal defense costs is critical," he urged. "American interests are at stake here, too."


In a letter from prison, Sheppard wrote: "Detention is stressful and disorienting. [We] appear before the Immigration Court shackled hand and foot....[We] have no access to the legal material and evidence which is stored in the baggage [we] carried on arrival....[ We undertook our action to seek asylum] as a matter of principle, as a political gesture to protest an iniquitous British law which inhibits free speech and the democratic process." To win political asylum in the U.S., claimants must prove that they have a well-founded fear of persecution in their homeland, on one of several grounds including political opinion.


While U.S.courts have frequently stated that "prosecution" does not equate to"persecution, " there are cases where confinement and prosecution under repressive laws have been held to constitute persecution, says Leichty.

Leichty is best known previously for representing Ernst Zundel, an internationally known Holocaust revisionist and publisher who in 2003 was arrested in Tennessee, taken away from his U.S. citizen wife, and deported to Canada on the pretext that he had missed an INS (Immigration and Naturalization Service) appointment.


After Leichty was hired to succeed Zundel's first Tennessee immigration lawyer, Zundel won the right to a hearing in Knoxville federal court, but his initial bid to overturn his deportation on habeas corpus grounds was rejected in an unpublished decision of a federal court of appeals in Cincinnati, and Leichty says he and Mrs. Zundel are now prosecuting Zundel's remaining claims in Knoxville.-30-

Hello Tony,

I was speaking to a friend of Simon's, Rick Hobbs, who attended Leeds court on Monday 28th July, and Simon is to be retried for the remaining charges in December. Mr. Davies says that Simon and Steve must raise £5,000 asap if they are to have any chance of remaining in the USA.

The Heretical Two need some help in the way of a fund raising drive. It seems that USD 10,000 should do the trick, or £5,000. Are you able to tap any sources in England or the USA to help them?

A Preston man who skipped bail and fled abroad after being convicted of distributing racist material, is still locked up in the United States.

Stephen Whittle was found guilty of a series of race-related offences by a judge at Leeds Crown Court.

The 41-year-old, from Avenham Lane, Avenham, was due to return to court on Monday, July 14, while a jury continued deliberating over further charges, but he did not turn up.

It is believed Whittle travelled with his co-defendant Simon Sheppard from the UK to Ireland by ferry before taking a direct flight to Los Angeles.

Both were detained by immigration officials at Los Angeles Airport.

Whittle was convicted of five counts of publishing racially inflammatory written material.

Simon Sheppard, 51, of Brook Street, Selby, North Yorkshire, was also found guilty after a seven-week trial of nine counts of publishing racially inflammatory written material on a website.

A Crown Prosecution Service spokesperson said they were both still in custody in the USA and a re-trial date for Sheppard has been set for December 8.

Racist who fled hate trial caught in America

A racist who fled the country after being convicted of five charges of publishing racially inflammatory material has been apprehended in America.

Stephen Whittle, 41, of Preston, Lancs, had written five offensive articles under the pen-name Luke O’Farrell, which were published on the internet.

He was convicted last Friday after a seven-week trial at Leeds Crown Court, but neither he nor his co-defendant, Simon Sheppard, of Selby, North Yorkshire, appeared when the hearing resumed on Monday.

Humberside Police, who had mounted the case against Whittle and Sheppard, sent out an all-ports alert. Sheppard, 51, ran the website on which Whittle’s articles appeared.

The pair were detained in Los Angeles where they are believed to have asked for political asylum. They were understood to be awaiting a hearing that would decide whether or not they would be granted asylum or be sent back to Britain.

During the hearing, prosecutor Jonathan Sandiford told the jury that Sheppard and Whittle held what they might regard as fairly extreme views about people who were Jewish, black, Asian, Chinese, Indian and, in reality, anyone who was not white. He said: “People in this country are entitled to be racist and they are entitled to hold unpleasant points of view.

“But what they aren’t entitled to do is publish or distribute written material which is insulting, threatening or abusive and is intended to stir up racial hatred or is likely to do so.”

The court heard that Sheppard’s website attracts 4,000 visitors a day.

Other articles on the same site included one written during the 1960s by the leader of the American Nazi Party, George Lincoln Rockwell.

The court heard that Sheppard was investigated by police following complaints and when his flat was searched in March 2005 police seized a number of computers and found documents entitled “Dumb Niggers, Gloating Jews”, “Make Niggers History”, “Diversity = Death” and “Rockwell, the
Swastika”.

Sheppard has been found guilty of 11 of the 18 counts he faced. The jury failed to agree on seven further charges relating to the possession, publishing and distribution of two pamphlets called “Tales of the Holohoax” and “Don’t Be Sheeple”.

The case was adjourned until July 28 when the prosecution will say whether or not it will seek a retrial.

To-day (Monday 14th July) a jury found the "Heretical Two", Simon Sheppard and Steve Whittle, aka Luke O’Farrell, guilty on one more count, and Sheppard alone guilty on a second count, this time by a majority of ten to one (a juror having been discharged early in the trial after she broke her ankle).

The jury had unanimously found Sheppard guilty on nine counts and Whittle on four on Friday 11th July.

Neither Sheppard nor Whittle was in court.

Warrants have been issued for their arrest.

The jury were unable to agree a verdict on the remaining seven counts (with which Sheppard alone is charged) after more than four days of deliberation.All the counts upon which the "Heretical Two" have been convicted relate to postings on a web site hosted in Torrance, California.

The counts on which the jury were unable to agree included distributing Tales of the Holohoax and Sheppard’s own newspaper, Don’t be Sheeple.

In scenes reminiscent of the first Griffin trial in the same court at Leeds, prosecuting counsel, Jonathan Sandford, immediately leapt to his feet and told the judge, His Honour Judge Grant, that the prosecution would seek a re-trial of Sheppard.

Judge Grant has listed the matter for a further hearing on 28th July, when the prosecution will ask the judge to sentence the Heretical Two in their absence, if they have not by then surrendered to custody.

STOP PRESS.......Leeds Trial - defendants found guilty!




Today, the Crown Court returned the first part of the verdicts on the “Heretical Two”.

Today the jury returned the first part of the verdicts on the “Heretical Two”.

Steve Whittle (pen name Luke O’Farrell) was found guilty of all the five charges against him.

The other defendant, Simon Sheppard was found guilty of nine of the charges against him with the jury presumably returning a verdict on the rest on Monday.

Both comrades were allowed bail.

It looks like Simon will be sent to prison having served time previously for a Race Act conviction, Steve, having no previous convictions, may be lucky and keep his freedom hopefully.All the verdicts so far have been for internet articles on USA-based servers.

It looks like the loophole has been closed and now is the time to be careful in the future with what we write on the net in 'Soviet' Britain.
